WIN A LIMITED EDITION CALLAWAY APRIL MAJOR GOLF BAG & HEADCOVERS

This “WIN A LIMITED EDITION CALLAWAY APRIL MAJOR GOLF BAG & HEADCOVER” prize draw (Competition) is promoted by (a) for UK residents: Callaway Golf Europe Limited of Unit 27 Barwell Business Park, Leatherhead Road, Chessington, KT9 2NY, United Kingdom or (b) for EU residents, Callaway Golf EU B.V of Herikerbergweg 88, 1101CM Amsterdam (Promoter, us, we, our).

Who may enter this Competition:

1. This Competition is a prize draw and is open to residents of Austria, Denmark, Finland, France, Greece, the Netherlands, Slovakia, Sweden or the United Kingdom (Eligible Countries) aged 18 years or over.
2. No employees of the Promoter or any member of the Topgolf Callaway Group Corp group of companies, which together with the Promotor are the TCBrands Group nor any of their immediate family or any of TCBrands Group’s franchisees, licensees, distributors, resellers, agents or any third party directly associated with administration of the Competition are eligible to enter this Competition.
3. To be eligible to enter the competition, you must first complete a purchase of a dozen Chrome Tour April Major golf balls. Upon purchase, you will automatically be entered into the Competition, with no additional sign-up necessary. In entering the Competition, you confirm that you are eligible to do so and eligible to claim the Prize. We may require you to provide proof that you are eligible to enter the Competition.

How to enter this Competition:

1. The Competition will run from 00:00 GMT, 8th April (Opening Date) to 11:59PM GMT, 30th April (Closing Date) inclusive. Purchases of the entries received after the Closing Date are automatically disqualified.
2. We do not accept (a) responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind’ or (b) proof of transmission as proof of receipt of entry to the Competition.
3. By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.

Please note that this customer service email is not monitored 24/7. We will use reasonable efforts to respond to your query as soon as possible but are not responsible if you are not able to enter the Competition due a delay in responding to your query.

The Prize:

• One Limited Edition April Major Staff Bag
• One Limited Edition April Major Mallet Headcover
• One Limited Edition April Major Blade Headcover

• Other than our right to exchange the Prize (or part of it) for a suitable replacement of equal value and purpose, the Prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
• The Prize does not include any products ordered additionally by the winner that are not specifically included in the Prize.
• Our standard product lead times of 6-8 weeks apply to any orders of products. We will only ship to Eligible Countries using standard shipping. You are responsible for any additional costs for customs and shipping if you wish to have products shipped other than to an Eligible Country or require expedited delivery.
• Any products supplied as part of the Prize comes with our standard consumer manufacturer’s warranty against manufacturing defects and we will, at our option, either repair or replace any such defective products during the warranty period. We make no representation or warranty regarding the quality of the Prizes, the availability of our e-commerce platforms and any conditions, warranties, or other terms implied by statute or common law are hereby excluded to the fullest extent permitted by law. Nothing herein affects your statutory rights.
• The Prize may be subject to taxes in your country of residence. You are responsible for determining if winning the Prize requires reporting and payment of any taxes that may be imposed in your country of residence.

How will the winner be selected:

1. There will be one winner whose entry will be drawn at random from all eligible entries from all Eligible Countries.
2. We will make all reasonable efforts to contact the winner using the email provided at the time of entry. If a winner does not respond to us within 7 days of being notified by us, then the winner's Prize will be forfeited and we will be entitled to select another winner using the process described above.
3. If the winner rejects the Prize or if the entry is invalid or otherwise in breach of these terms and conditions, the winner will forfeit their right to receive the Prize and we are entitled to select another winner using the process described above.
4. The decision of the Promoter is final and no correspondence or discussion will be entered into.

Your Privacy:

We have a legitimate interest in operating sweepstakes, contests and other promotions. In some contexts, we are also required by law to collect information about those who enter our sweepstakes, contests and other promotions. By entering this Competition, you agree:

• To the processing of your personal data under our Privacy Policy including the transfer of your personal data to the United States of America and to our third party sub-processors. We will only transfer your personal data in accordance with applicable law and have in place appropriate data processing agreements, including model clauses, and organisational and technical measures.
• We must either publish or make available information that indicates that a valid award took place. To comply with this obligation we will publish the surname and country of the winner on our websites and social media pages and send the surname and county of the winner and, if applicable copies of their winning entries, to anyone who emails europecustomerservice@callawaygolf.com  within one month after the Closing Date. If you object to any or all of your surname, county and winning entry being published or made available, please contact us at europecustomerservice@callawaygolf.com . In such circumstances, we must still provide the information and winning entry to the relevant regulatory bodies including the Advertising Standards Authority on request.

General:

1. To the extent legally permitted, no member of the TCBrands Group will in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by our negligence or that of their employees. Your statutory rights are not affected.
2. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud).
3. If there is any reason to believe that there has been a breach of these terms and conditions, we may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
4. For UK residents: These terms and conditions and this Competition is governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom. For EU residents: These terms and conditions and this Competition is governed by the law of the Netherlands. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts of the Netherlands or their country of residence if in the EU.

DISCLAIMER:

The competition is running from 08-04-2024 until 30-04-2024. One winner will be chosen from all correct entries received. We will contact the winner within seven days of the competition closing.
